1. About these terms
These terms govern use of the Show Me Your Pop Up website and, once made available, the mobile application and related services (together, the “Service”). By using the current website, you agree to the terms that apply to the pre-launch website. Additional or updated terms will be presented before accounts, vendor tools or paid services become available.
2. Who operates the Service
- Trading name: Show Me Your Pop Up
- Trading status: Pending trading
- Legal or company name: Pending trading
- Business address: Pending trading
- Company number: Pending trading
These details will be completed before trading begins.
3. The pre-launch website
The current website provides general information about the planned Service. Search boxes, buttons, sample listings, app previews, launch locations, dates and features are illustrative unless expressly stated otherwise. We may change or withdraw pre-launch material without notice.
The general contact-email function is disabled during pre-launch. The privacy address remains available for data-protection requests and legal privacy enquiries.
4. Accounts and eligibility after launch
When account registration opens, you must provide accurate information, keep sign-in credentials secure and tell us promptly about suspected unauthorised access. You are responsible for activity carried out through your account unless caused by our failure to use reasonable care.
You must be at least 18 to create a vendor account, enter a paid subscription or act for a business. General user age requirements will be confirmed before public launch. If you act for an organisation, you confirm you have authority to bind it.
5. What the Service does
The Service is intended to help users discover independent vendors, markets, events and temporary trading locations. It may allow vendors to create profiles and listings, publish locations and trading times, check in and out, and communicate public business details.
We provide a discovery platform. Unless expressly stated, we are not the vendor, event organiser, venue, delivery provider or agent in a transaction between users and a listed business.
6. Listings and location information
Listings may be created by independent businesses. Times, locations, availability, products, prices, accessibility and event details can change. Users should confirm important information directly with the vendor or organiser before travelling or purchasing.
Maps, distances and device-location results are approximate. They must not be used for emergency services, navigation where safety depends on precise positioning, or any purpose requiring guaranteed accuracy.
7. Vendor responsibilities
Vendors must ensure that their profiles, logos, contact details, claims, locations and listings are accurate, lawful and current. Vendors are responsible for their products, services, licences, permits, insurance, taxes, food-safety duties, consumer obligations and compliance with venue or local-authority rules.
A vendor must own or have permission to publish everything it uploads and must not mislead users, impersonate another person, infringe intellectual-property rights or publish another person’s private information without authority.
8. Acceptable use
You must not:
- use the Service unlawfully, fraudulently or to harm another person;
- submit false, abusive, discriminatory, obscene or misleading content;
- attempt to bypass security, access another account or disrupt the Service;
- scrape, harvest or systematically extract Service data without written permission;
- upload malware or content that infringes rights; or
- use listings or personal information for unsolicited marketing.
9. Moderation and account action
Once the Service launches, we may investigate content, restrict visibility, remove listings or suspend an account where reasonably necessary to protect users, comply with law, address a breach or maintain the Service. Where appropriate, we will explain the action and provide a reasonable way to raise a concern.
10. Subscriptions and payments
No subscription or payment is currently offered. Before paid features launch, we will state the price, billing period, included features, renewal arrangement, cancellation method and any trial terms before purchase. App-store purchases may also be governed by the relevant store’s terms.
Nothing in these terms limits statutory cancellation, refund, digital-content or service rights that cannot lawfully be excluded.
11. Intellectual property
The Service, brand, software, design and original content belong to the operator or its licensors. You may use the Service only for its intended purpose. Vendors retain ownership of content they upload but grant us a non-exclusive, worldwide, royalty-free licence to host, copy, format and display that content as needed to operate and promote their listings. This licence ends when the content is deleted, except for necessary backups or legal records.
12. Third-party services and links
The Service may use or link to mapping providers, app stores, payment services, social networks and vendor websites. Independent third parties control their own services and terms. A link or listing does not amount to endorsement.
13. Availability and changes
We aim to provide a reliable Service but cannot promise uninterrupted or error-free availability. We may maintain, secure, update or discontinue features. If a change materially affects a paid service, applicable consumer rights and any specific subscription terms will be respected.
14. Responsibility and liability
Nothing in these terms excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
We are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care. We are not responsible for unforeseeable loss, independent vendor conduct, or inaccurate information supplied by a third party where we used reasonable care.
If you use the Service wholly for business purposes, we are not liable for loss of profit, revenue, business, anticipated savings, goodwill or indirect loss, subject always to liabilities that cannot legally be limited.
15. Privacy and account deletion
Our Privacy Policy explains how personal information is handled. Once accounts launch, users will be able to request deletion in the app and through the website deletion page. Deleting an account may not automatically cancel a subscription managed by an app store.
16. Changes to these terms
We may update these terms to reflect launch, new features, law, security or business changes. Material changes will be brought to registered users’ attention where required. The current version will remain at this URL, which the app opens directly so wording is maintained in one place.
17. Governing law
These terms are governed by the laws of England and Wales. If you are a consumer, you retain any mandatory protections and may bring proceedings in the courts available under applicable consumer law. Business disputes are subject to the courts of England and Wales.
18. Contact
General enquiries are marked Coming Soon during pre-launch. Data-protection enquiries can be sent to privacy@showmeyourpopup.com.
